Terms and Conditions of Sale
1. About the Products
Our GPS trackers are electronic location monitoring devices that rely on GPS satellite signals and GSM mobile networks. Performance depends on external factors including signal availability and network coverage.
A SIM card is required for operation. Where provided free of charge, the SIM is supplied by GiffGaff and subject to their own terms and network conditions.
We do not guarantee uninterrupted signal, network availability, or location accuracy.
Our GPS devices may operate in conjunction with third-party online tracking platforms. Where such services are provided by an independent third party (including but not limited to GPS-Trace / Ruhavik), those services are governed by the third party’s own terms and privacy policies.
Stray Star Ltd does not control and is not responsible for the operation, availability, data processing practices, or performance of third-party tracking platforms.
Where you choose to use a third-party tracking platform, you enter into a separate agreement directly with that provider.
2. Formation of Contract
A contract is formed when we send you an order confirmation email. We reserve the right to decline orders.
3. Pricing and Payment
All prices are shown in GBP and include VAT where applicable.
Payment is processed securely via Paymentsense. We do not store full card details.
4. Delivery
Delivery times are estimates and not guaranteed. Risk passes to you upon delivery.
5. Your Right to Cancel (Consumer Contracts Regulations 2013)
You have the right to cancel your order within 14 days of receiving the goods without giving a reason.
Refunds will be made using the same method of payment used for the original transaction unless you expressly agree otherwise.
To exercise your right to cancel, you must inform us by email or via our contact page within 14 days of delivery.
You then have a further 14 days to return the goods.
We will refund the purchase price (including standard delivery costs) within 14 days of receiving the returned goods.
You are responsible for return postage costs unless the goods are faulty.
We may reduce your refund if the value of the goods has been diminished due to handling beyond what is necessary to establish their nature, characteristics, and functioning.
Exceptions
If a SIM card or network service is activated at your request during the cancellation period, you acknowledge that services may begin immediately and that your right to cancel may be affected in accordance with Regulation 36 of the Consumer Contracts Regulations 2013.
Activated SIM cards, top-up credit, or network services may not be refundable once activation has occurred where permitted under consumer law.
6. Faulty Goods (Consumer Rights Act 2015)
If goods are faulty, not as described, or not fit for purpose, you are entitled to remedies under the Consumer Rights Act 2015, including repair, replacement, or refund.
7. Warranty
Products are covered by a 12-month warranty against manufacturing defects. This does not affect your statutory rights.
8. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot legally be excluded under applicable law.
GPS tracking devices rely on signals from global positioning satellites, mobile network mast towers, cellular data services, and related telecommunications infrastructure. Signal strength, accuracy and availability may be affected by factors outside our control, including but not limited to:
- Satellite positioning and orbital movement;
- Atmospheric conditions and weather;
- Physical obstructions such as buildings, terrain or vehicles;
- Indoor use or signal reflection (“GPS drift” or “signal bounce”);
- Mobile network coverage, mast availability or roaming agreements;
- Network congestion or temporary service outages;
- SIM card configuration or network provider restrictions;
- Battery charge level or device handling.
We do not guarantee uninterrupted operation, continuous connectivity, precise location accuracy, or availability of GSM, GPRS, 3G, 4G or successor network services.
The device is an assistive monitoring tool only and must not be relied upon as a safety device or as a substitute for personal supervision or emergency services.
Subject to the above and to your statutory rights, our total liability arising out of or in connection with any contract for the sale of goods shall not exceed the purchase price paid for the relevant product.
We shall not be liable for any indirect, consequential or economic loss including loss of profit, loss of opportunity, or loss arising from network failure or signal interruption.
9. Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control.
10. Entire Agreement
These Terms constitute the entire agreement between you and Stray Star Ltd relating to the purchase of goods and supersede any prior representations or agreements.
